Terms of Use
1.1 ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF USE
The services available at the domain and sub-domains of http://www.sweet-charity.net ("the site") are provided by Sweet Charity ("SC" , "we", "us" or "our"). Use of our bidding facility ("auction", "SC auction") constitutes acceptance of the Terms of Use. If you do not agree to be bound by the Terms of Use, you may not use or access our auction. By creating an account, you become a "User". By adding an item ("offer", "listing", "service") in the auction you furthermore become an "Auctionee". By placing a bid on a listing in the auction you furthermore become a "Bidder". These Terms of Use comprise the entire agreement between User and Sweet Charity and supersede all prior agreements between the parties, regarding the subject matter contained herein.
The auction is set up by Sweet Charity to offer members of the general public the option of placing bids for listings in the auction, for the purpose of fundraising. The cost of placing a bid is nil ("free"). All monies raised in the auction will be donated to the chosen charity, no funds whatsoever are retained by SC or diverted to third-parties. Donations are for the time and skills of people involved in the auctions only. Sweet Charity believes in the principles of noncommercial fair use and fair dealing.
1.2 WHO CAN USE THE SC AUCTION
The services provided by the auction are not available to individuals under the age of 18 years old or any other individuals who are legally prohibited from, or otherwise incapable of, entering into binding contracts. SC reserves the right to accept and reject bids.
1.3 ITEM DESCRIPTIONS
Offers are listed along with a description, SC is not responsible for misrepresentation in listings, or misinterpretation by Bidders. Whilst SC strives to ensure that listings are accurate, complete and up-to-date, we cannot guarantee, and will not be responsible for any damage or loss related to the accuracy, completeness or timeliness of the information. Such information is provided without warranty of any kind. In no event shall SC be liable for any claims, demands and damages arising out of or in any way connected with the use of the site, the delay or inability to use the site, or any information or services obtained from the site. SC advises all Bidders to consider the auction and items secondary to the fundraising and suggests they bid no more than they would be comfortable donating to charity normally.
Sweet Charity makes no guarantees regarding the provision or quality of the services being offered or the item(s) being created. Sweet Charity is not responsible for the services or items being offered and does not own, distribute, or solicit any of the services or items being offered by individuals via this website.
1.4 STARTING PRICES
Auctionees are responsible for setting a starting price for their listing, equal to or above 1.00 USD. This starting price is disclosed on the site. If there are no bids above this starting price, then SC is not obligated to "sell" the listing.
1.5 BIDDING DEADLINES
Bidders may make a bid using the auction at any time after bidding opens and prior to the close of the bidding. This deadline is at the sole discretion of SC and subject to change. SC has no obligation to inform Bidders of changes to the Bidding Deadline and accept no responsibility for any damage or loss resulting from any confusion or misunderstanding that this may cause.
1.6 WHEN BIDDING CLOSES
After bidding closes, SC will contact the highest Bidder(s) for each listing by email within 24 hours of auction close to inform the Bidder that their bid was the highest and deliver pertinent information. SC is not responsible for the non-receipt of e-mails and advises any winning Bidder to contact them if they have not received notification within 24 hours.
1.7 DONATIONS
The Bidder will have 120 hours within which to make their donation. Should the donation not be successfully made within 120 hours, or SC not be informed of a successful donation, the opportunity to donate will pass to the second highest Bidder, and so on, until such time as a bid is redeemed or there are no more bids on the listing.
1.8 ITEM DEADLINES AND DEFAULTS
Deadlines on site are intended as guidelines and can be superseded by any negotiations between Auctionee and winning Bidder if relevant. Should the Bidder fail to produce the agreed item by the agreed date, they are considered to have defaulted. SC is not responsible for providing alternate items, but does allow use of the "Pinch-hit" service for all valid bids. The service is not guaranteed.
1.9 USER DETAILS
Users are entirely responsible for any and all activities, which occur under their account. Furthermore, Users agree to immediately notify SC of any unauthorized use of User's contact details or any other breach of security known to the User.
Sweet Charity is not affiliated with RAINN or any other charities that donations are raised for in any way. However, where possible, we will contact the charities in advance for permission to raise funds on their behalf.
